Terms of Use for Renters

Welcome to Rent to Drive! These Terms of Use (“Terms”) govern your use of the Rent to Drive website and mobile application (the “Service”) as a renter. By using the Service, you agree to be bound by these Terms.

1. Use of Service

1.1 Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are of legal age to form a binding contract with Rent to Drive.

1.2 Account Registration: To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3 User Conduct: You agree not to use the Service for any unlawful or prohibited purpose. You also agree not to:

– Violate any applicable laws or regulations.
– Use the Service to engage in fraudulent or deceptive activities.
– Use the Service to harass, intimidate, or harm others.
– Interfere with or disrupt the Service or servers or networks connected to the Service.
– Use the vehicle for commercial purposes like taxi, or e-hailing services.

2. Vehicle Rentals

2.1 Booking and Payments: By booking a vehicle through the Service, you agree to pay the rental fee, caution fee, taxes, and any additional fees as specified in the booking details to confirm your reservation. Without payment, there is no reservation. Payment is processed securely through our platform.

2.2 Vehicle Inspection: You agree to inspect the vehicle before, during and after the rental period and to report any damage or issues to Rent to Drive immediately. Failure to report damage may result in renter’s liability for repair costs. You are advised to take clear pictures of all the exterior, interior, undercarriage, roof, doormats, floor mats, entertainment accessories, seats, dashboard, instrument cluster, safety equipments, extra tyre etc. These will be inspected when the vehicle is returned and renters will be liable for any damages or missing item.

2.3 Compliance with Laws: You agree to comply with all applicable laws and regulations while operating the rented vehicle, including traffic laws, insurance requirements, and licensing requirements.

2.4 Logistics: You agree to pay for any logistics as it relates to vehicles delivery to your location and pick up from your designated address including toll fees and parking fees.

2.5 24-hr Rental timing: Rentals are from 7am till 7am the next morning and you agree to comply with the timing or pay for extra hours as it pertains to lateness or rental extension.

3. Liability

3.1 Insurance Coverage: All renters who pay for insurance will be covered in the event of a damage, but you may be responsible for a deductible or excess charge in the event of excess damage, loss, or theft of the vehicle.

3.2 Indemnification: You agree to indemnify and hold harmless Rent to Drive and the vehicle owner from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the rented vehicle.

3.3 Physical and Mechanical damage: Renters who do not pay for insurance are 100% responsible for any physical damage they incur on the rented vehicle. Renters will bare a Mechanical damage liability of 50% of the total estimated repair cost as it concerns the powertrain. In view of this, renters are advised to pay close attention to the instrument cluster of their rental cars and report any abnormalities as fast as possible.

3.4 Fueling: Renters are responsible for purchasing good fuel from trusted gas stations for their rental cars. Renters that purchase bad fuel will be responsible for any mechanical damages as it pertains to fuel pump, injection system and the engine.

3.5 Refueling fee: Renters will be charged refueling fee if they return the rental car with fuel lower than it was during the pick up/delivery. However, renters can pay for fueling upfront and they have the vehicle delivered with as much fuel as they paid for, but the car should never be returned with the reserve light.

3.6 Late return fee: Renters will be charged hourly late return fee if they do not return the rental car by 7am or rental expiration time.

3.7 Cleaning fee: Renter are liable to pay cleaning fee if the rental car returns dirty and unkempt. Renters are hereby advised to keep rental cars clean as it affects their ratings.

4. Termination

4.1 Termination by Rent to Drive: Rent to Drive reserves the right to terminate or suspend your access to the Service without prior knowledge if you violate these Terms or engage in any fraudulent or illegal activities.

4.2 Termination by User: You may terminate your account at any time by contacting Rent to Drive or using the account deletion option in your profile settings.

5. Miscellaneous

5.1 Changes to Terms: Rent to Drive reserves the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on the Service. Your continued use of the Service after the posting of the updated Terms constitutes your acceptance of the changes.

5.2 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

By using the Service as a renter, you agree to these Terms of Use. If you do not agree to these Terms, please do not use the Service.
